The law has finally been changed to include co-habiting couples.

Your relationship to your partner
When your partner died you must have been one of the following:
- married or in a registered civil partnership
- living together as though you were married

A quick look at the link that suggests that if you are co-habiting but not married, you will only be eligible if pregnant or claiming child benefit though, so co-habitees are stilll treated less favourably than spouses.2
