Evening all,
Ive got a bit of an odd issue and hopefully someone more knowledgeable than me can shed some light on it.
Ive got a bit of an odd issue and hopefully someone more knowledgeable than me can shed some light on it.
I have received a letter today from Mortimer Clarke solicitors, stating “As you are aware, proceedings were issued against you in the county court business centre on .” (Im presuming there should be a date here but it’s blank.)
”we are instructed to make an application to the court requesting that the stay on the proceedings be lifted and the judgement be granted…”
After several tedious phone calls, I have since found out the CCJ claim form was sent in November 2020, but the CCJ was never issued. I had apparently made contact with them which put the account on hold, and they’ve forgot to proceed with it for over 2 years.

My issue is they are requesting full payment (~£2k), or the CCJ is issued and I pay it that way. I would prefer not to have a CCJ, but cannot come up with that kind of money immediately. However I did offer to pay over 4 months, which I was told is not an option.
I’m curious if there is any stipulations on time frames between the claim form issue, and the CCJ issue? I’m hoping to buy some time to allow me to pay the debt before the CCJ is issued.
it may also be worth noting that I have no memory of replying to the claim form to set up a payment plan, and it is also registered at my old address.

Thanks in advance for any help I may receive.

There are strict timeframes for submitting your defence, but not for the length of time a case can be put on hold.
Have a look at debt camel, there is also a link to Legal Beagles where they can advise your next move -
