Consumer Rights Act 2015 and Ebay purchase

I bought a set of 3 gardening tools on Ebay about a month ago. Within 2 week of using the trowel it had sheared off from the handle and is clearly defective. I sent photos to the seller and asked for a full refund. Seller replied apologising and asking if I had used the other 2 items in the set, a fork and weed extractor. I haven't used those items as my interest was in the trowel but it wasn't possible to buy it as single item. I suspect they will be just as useless as the trowel and fall to bits!
I haven't replied yet as I think the seller will only offer me a pro rata refund based on the value he places on the trowel.
Am I entitled to a full refund as the items were supplied as one package?

No, under Consumer Rights legislation you are entitled to what you paid for, a full set of 3 gardening tools.trophy3681 said:

It is possible that when you finally reply that only the trowel is faulty they will just send a replacement trowel.
The set might be OK afterwards. They just get one 'go' at repair or replacement, so if there is another failure you are entitled to ask for a refund but depending on the circumstances it might be a partial refund.0 -
If it’s less than30 days from the last ETA on the order, or the actual delivery date recorded on the order, open a return from the purchase history section and select the item is defective (or closest wording) and the seller will have to provide a pre-paid label for the return and refund. If you are outside 30 days then eBay’s cover has expired. In the game of chess you can never let your adversary see your pieces0

That's the important question above. CRA15 won't apply for a private purchase.

Selling new (were they new?) sets of gardening tools seems much more likely to be done for business purposes than not - how their account is registered with ebay will not be important to CRA.
But a banker, engaged at enormous expense,Had the whole of their cash in his care.

As much as it could be a private seller that had an unused set and just wanted to sell them. Until the OP comes back and answers, then we'll never know.theoretica said:powerful_Rogue said:That's the important question above. CRA15 won't apply for a private purchase.
