CPR and Small Claims help! massive costs order against me!

Hello Please help

I put a claim in small claims, It had not gone on small claims track

Defendant put a strike out in 

hearing  - judge agreed with them and told us to pay £9k

The did not copy us in the bundle they sent to court - they sent to judge inly under cpr 39.8

please help

    Why is this in the Parking Tickets and Fines forum if you put the claim in?

    Also, which part of CPR 39.8 applies to the bundle such that it did not have to be submitted to you? I find it hard to imagine any scenario in which the bundle need not be sent to the claimant, and also hard to imagine that a judge would consider that they had followed the CPR if they had not sent the bundle to you. But CPR 39.8 sub-section 3 allows a communication not to be sent to you IF there is a compelling reason why you should not be sent it and that reason is clearly stated in the communication. It is therefore possible that the judge agreed with the defendant that your should not have been sent the bundle.

    On what grounds did the defendant request the claim be struck out?  

    You might need to appeal the decision, but you might end up with a great award of costs against you. Are you prepared for this?

    How much did you try to claim and what for, who was the Defendant?

    What is this for? 

    What did you put a claim in for?
    From the Plain Language Commission:

    I put a claim in for 1,000
    The defendant wanted it struck out with no chance of winning.
    the judge said on the call she had the bundle 24 hours before and I was not copied in (judge did not say that )
    I got bundle at time of call.
    not sure if different to the one the judge got .

  • Why was it not on the small claims track?
  • The judge said it never got allocated .

  • Ok sorry if I am being vague. I am so distraught .
    The defendant said I had no chance of winning and has spent 9,000 in legal fees. So the judge awarded them for me to pay
