I'd add to paragraph 3 where you talk about the CRA 2015:
Under that Act, ambiguous terms must be interpreted in the way that most favours the consumer.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for feedback. Have gone through the Money Claim Online process. It wasn't as bad as it looked like it was going to be at first. And the template fitted in the defence box including paragraph 10.
Now I guess we wait? Will there be an email if there is an update or do you have to keep logging into your government gateway page?0 -
I would check MCOL weekly, but you should be following the 8 steps in the defence template thread
There wont be any emails1 -
Just posting to close out the saga. We followed all the processes, had the mediation, rejected their offer of a 50% discount (ha!) countering with the original 'shortfall' of 50p… And this morning we went to the small claims court for the hearing. They didn't even show up so we won by default. Bit of a damp squib in the end! Disappointed we didn't get to put our preparation and evidence to the test. But at least it's the end of the story.
