Motorpoint deposit, can I insist on refund of deposit?

I did a lot of research and found the car I wanted online with Motorpoint.

I called and spoke to sales adviser who took a £149 deposit (using credit card) on 25th Jan for a £20,000 car (with no Ts & Cs explained) and I made it clear I wanted car delivered (to ensure I had 14 days distance selling rules applied)

I currently have a lease car off hire on the 20th, and delivery was confirmed for the 15th Feb. then get emails asking me to call and arrange delivery. I email back and they say they can't find any mention of delivery for the 15th - until that, is I forward the email I had. 15th now unavailable, but it's now the 13th, which means taking the morning off work (or wait until the following week - which is getting close to my off hire day)

I now read online that the deposit I paid is non-refundable if I cancel the sale. My thoughts are that if this 2nd "confirmed date" is postponed (by them), can I insist on cancellation, and my deposit refunded? How many times is delivery change assumed to acceptable?

TIA

Whenever I used Motorpoint the deposit was refundable. Has this changed recently?

Edit - It has seemed to have changed and states the deposit is non-refundable.

Might give them a miss when I look for my next car now! Their service was never great when I used them anyway, not sure if this has since changed?

What do their terms say about delivery dates - i would imagine it would be something like delivery days are not guaranteed and subject to change? If those changes are covered then I think you just have to accept it and make the best of it, or else cancel and lose your deposit.

While the delay is frustrating, you say you did a lot of research to find the car you want.

If you cancel now, whether or not you get the deposit back, what wait and inconvenience will you incur for an alternative car?

If you have bought the car totally remotely and never saw the car, then CCR allow you to cancel for any, or no, reason from the point of placing the order up to 14 days after delivery.
