Mortgage bankruptcy search???? K18 form-pending bankruptcy

PLEASE HELP!!!!!!! So we were due to complete and then they completed a bankruptcy search and it came back with a pending action on the land registry from 4 years ago. The debt was paid and no BR happened. Anyway the lender has said we need to get it removed form the land registry before they will release funds. Anyone know how to do this? We have contacted a solicitor for advice but was wondering if we can do it ourselves? or if anyone knows how long the process may take?????

    Hi,

    I know you say that no bankruptcy happened but whoever put the pending action notice on the entry at Land Registry obviously just left it there, even after the debt had been settled. Now, any lenders will just assume that a bankruptcy did happen. Even though it didn't. It will be removed next year but that is no good to you right now. 

    There's information in the following link about what to do when a bankruptcy ends (though we know there wasn't one)

    BUT you are going to need a copy of a court order permitting the cancellation (or ‘vacation’) of the entry. So you will need your solicitor to get a move on. (Didn't you have a conveyancing solicitor acting for you already though? They should have spotted this before now if so . . . It's also a bit puzzling as to why the bankruptcy search has only been done now, at the eleventh hour.)

    Info in the above link tells you how to apply to cancel a Land Registry notice and it does seem to be quite straightforward - but you are going to need that form from the court.
