SMART PARKING BURY PCN (over stay fine)

So i have received a parking charge notice (PCN) from (SMART PARKING) for a supposed over stay at ANGOULEME WAY RETAIL PARK BURY.
I am new to this whole site/ forum, so completely missed the whole 'NEWBIE' form and already responded to the PCN letter i received from SMART PARKING as i knew i wasn't in the wrong from what i had read on the signs around car park and what i did. Obviously not knowing that explaining how i wasn't in wrong wouldn't work with these people as they already had there minds set on imposing me with a £100 fine. 

With the above in mind, SMART PARKING knowing i am now the driver as well as the keeper, i have a few question i need clarity on.

1) I am concerned about continuing with appealing. they've made me aware if i pay now i will pay less. so rather than £100 it will be £60. i don't really have either, but i'd much rather pay the £60 rather than appealing and me loosing.

2) Does my appeal have a strong case if i do go ahead? 

DETAILS OF CASE:-

January 18th 2023, nearly one whole month later I receive a parking charge notice letter from Smart Park. In the letter they have said the PCN has been issued as a result of failing to pay for sufficient time at ANGOULEME WAY RETAIL PARK BURY on the 20/12/22. Stating I entered the car park at 11:22am and left the car park at 15:04pm.

Except this does not add up. If I entered the car park at 11:22am parked up checked the ticket machine which indicated I could stay in the car park for free for 45mins (without a ticket). I then entered the TK MAXX store and started my shop. I then left the store and returned to my car knowing I would need to purchase additional time to complete my shopping. as the 45mins free parking (no ticket needed) would have only taken me to 12:07pm. So at this point I pay £1.80 to stay in the car park for a further 2 to 3hrs. I then head off to look around other surrounding shops. After finishing my Christmas shopping and returning to my car. I leave ANGOULEME WAY RETAIL PARK BURY at 15:04pm. This is 3mins before my 3hrs of extended stay would have ended. 


3) I have been in touch with TK MAXX customer service team. they have said theres not much they can do as the issue is out of there control. they've told me to contact the landlords providing evidence. I have now emailed EDGERLEY SIMPSON HOWE PROPERTIES to see what assistance they can provide, but still waiting on a response.  


It seems like people are amazing at providing help on this forum, so any kind of assistance from someone who has been in a similar predicament or has a much better know how when it comes to issues like this would be greatly APPRECIATED! THANK YOU!

    The landlords complaint might well work.

    The good news as well is, that even though you threw away the 100% win you had (if only you'd not said who was driving - eek!) there is an alternative winning loophole appeal that @Grizebeck posts on Smart Parking threads.

    Go search! It is short & sweet for POPLA.

I had a quick look through, but can only seem to see info for helping people who haven't made SMART PARKING aware that they are the driver of the vehicle. of course when i responded to theIr initial PCN letter, i gave this information away unfortunately!

    I may be wrong or i may be just missing something but cant seem to find the winning loophole you've mentioned.

    I just used the forum's search facility and searched for posts with the word popla it them.
    I then refined the returned list by choosing latest and choosing only posts made by the user Grizebeck.

    The first post on the returned list is the one you want.

  • Hi, I have just had the same letter come through for the exact same parking at TK maxx in bury. Please could you tell me the outcome.

    I entered the car park at 11:38, I noticed on the parking sign it said 45 minutes free and thought this should be fine. Once in tk maxx I realised I wanted to go into more shops, so went and bought 3 hours of parking at 12:17 at £1.80 (luckily I kept the receipt and still have this to hand). I am then seen leaving at 14:50 meaning I still had another 27 minutes before my 3 hours was up. 

    Now I have received a letter charging me £100, I’m not sure how to go about this please let me know. Like I said I have the parking receipt to hand.

    Why have you posted on this old thread?
    You need to start your own or it gets confusing but to answer you timing question that is a typical PPC confusion con to trap you, your 3 hours was up at 14:38, the 45 minutes isn't added on it's included.

    @laurenleeson123, it is over eight months since @mt_vx_10 last logged in to MSE forums.
    You may not get a reply.

    Maybe keep it simple and do what @Coupon-mad suggested on this very thread on 3 February 2023 at 1:45PM?
