The 3rd-party liability of a motor policy covers injuries “caused by, or arising out of, the use of a motor vehicle …” [Road Traffic Act 1988, s145].
Is the car being ‘used’ while parked and being charged? I’d suggest not, and in that case Saga don’t need this particular clause to avoid liability.
Are you using when your car is stationary and unattended on a road without a MOT?
And in what circumstances does such a vehicle create a third party liability?

If the driver didn't apply the handbrake properly and it rolls away?
If it sets on fire/there is a fluid leak that damages the road or has to be cleared up/the handbrake fails,  due to negligence on the part of the driver (lack of recent servicing)?

However, rather a moot point as continuous insurance unless SORN'd and off the road is The Law.
Then the car is no longer stationary and secondly the act that caused the issue was in the use of the vehicle, (not) applying the brake to park.

Its typically difficult to prove negligence in a vehicle fire; when a car spontaneously combusts whilst parked and unattended causes are more likely to be vandalism or manufacturer defect than owners negligence... dont recall ever paying out on a TP claim for a parked car igniting.

I walked past one the other evening - the cable was under a rubber conduit, there were cones beside it (and the blue flashing light at the car end caught my eye first).    So that's fine.    But if it was just a black cable across a black tarmacked path at night-time and not in the streetlight - that would be different.
Over time, solutions will be found. Something like this will help (watch the short video)

Here's a site looking at the pavement issue/solution in particular:

    Gul-E  No Driveway? No Problem.

Or, for those who can't guarantee they can park outside, then install multiple charge points along a street, with the 'charge post' carried in the car, then plugged into the pavement:

Could be quite infuriating if you install one of these and the neighbour parks in front of your house. Adds a new dimension to parking rage.

Presumably  you need the ok from the council to cut up the pavement and no doubt Tracey Jobsworth will put a few obstacles in your way.

  • Some countries are just installing chargers all down the road, hundreds of them. Activated with a card that bills the owners home energy supply at their domestic rate.

Can't see the UK adopting such a progressive idea. Too expensive now all the money has been spaffed, and if it's a Tory government they won't let that opportunity for their mates to change you slip past.

The website does suggest they're marketing it at councils, not expecting householders to arrange it. I agree there are only going to be a limited number of cases where you can only park on-street but expect a space to be available.
