From what you are showing they have already blocked off access to the well by their fence behind their garage. And frankly I would have little sympathy for someone who didn't take access to an outbuilding into account when they built another building on their own property. It's a big assumption that a pedestrian access might mean vehicle access as well. that said it looks from your drawing that if they did want access to their garage they could gain that from the road at the side of their house which would mean them putting a drive along the back of their property. All at their own expense of course.
I'd be putting the ball back in their court and tell them to do the donkey work (& pay for it too) to see what can be done about access.I’m a Forum Ambassador and I support the Forum Team on Debt Free Wannabe, Old Style Money Saving and Pensions boards. Why do you not simply mow the entire area, and put a single gate in where the double one is now. That way they have no reason to do any mowing, and there is only a pedestrian gate so no way they can start thinking of driving their car across it.Credit card debt - NIL

bokvis said:There is a very old covenant for pedestrian access from the main road allowing for someone to go and draw water at a well onto another property on the other side although the well is no longer in existence. As others have said, the exact wording is important. If they have a pedestrian right (i.e. "on foot only") then they can't use it for vehicular access without your further permission. As they appear to have been granted permission to use the land as a ROW, the chances of them getting AP would seem to be negligible.0
