Child Benefit

I am asking on behalf of my daughter who has asked me to sort.

My daughter has 2 children ( different fathers ), the father of the eldest granddaughter claims the child benefit for this child but doesn`t give her any money, does anyone know the process that I need to follow to stop him claiming child benefit and for my daughter to get the money ?

    Who is responsible for the child ? Who do they live with ?
    I'm afraid there is no process that you yourself can follow. He would need to withdraw his claim, and when he does so, then your daughter can submit a claim instead

    So until he withdraws his claim for child benefit she can`t claim

    I don't think so, no.
    If the father isn't giving any money to the mother, then the other possibility would be to point out - either directly to the father or, if that' doesn't work, to HMRC, that by not passing on the money he is no longer eligible for the benefit.

    is the child benefit included in any financial arrangement  over the child?

    If not, then your daughter needs to contact the child benefit office and claim it.  If the father does not agree to  give up his claim, HMRC will decide who is eligible.

    Two people cannot get Child Benefit for the same child. If you and someone else are responsible for the same child, agree between yourselves who will get Child Benefit. If you cannot agree, HM Revenue and Customs (HMRC) will decide who will get it.

    @markyuleuk Yes your daughter can make a claim for the child benefit. Is there any reason he claims it? 
    What will happen is the child benefit office will freeze his claim while they investigate who the child lives with and who is responsible for the child for the biggest portion of the time. If that is your daughter they will close his claim and she will get the child benefit herself.

    When contacting CB, it would be helpful to detail that your GD lives with your daughter. That she is the point of contact for the school, GP, etc. That she provides for the child, etc.

    When deciding which parent has primary responsibility for the child CB will  consider:

    (Relates to TC, but the similar criteria is used for CB)

    Having the proof to hand and submitted to CB may speed up their decision processes.

    Were they still living together when he started claiming it, because there must’ve been a reason initially that it was put in his name?

    If the child lives with your daughter then the process is simply to submit a claim for Child Benefit. The office will contact the grandfather and ask him if he is OK with his child benefit being stopped and transferred to her. If he says no then they will contact you to provide evidence of the child's residency.

    Is there any court order or anything that says the child lives with granddad or similar to say she lives with your daughter? If the claim is contested then someone is going to have to provide some evidence of where she lives - so at least the address registered with school, GPs etc
