UKPC DCBL Defence for checks

Hi everyone. This is my first post - and I am new to forums. I hope that this is the correct place to put my draft defence for you to look over.

I received a CCBC claim with issue date 9.1.23.  I did my AOS today 17.1.23 (thanks for all the advice!).
Obviously details that could identify me have been changed.

Here is my draft defence:

The facts as known to the Defendant:

2. It is admitted that the Defendant was the registered keeper and driver of the vehicle in question.

The Defendant arrived at his new place of work on ___STREET 1____ at approx. 7am _______________ 2017. He parked in a road off __________STREET NAME 1____ (also referred to as ___STREET NAME 1____ on the claim forms but is in fact an unnamed road). This was not a car park. This was not a road with parking meters. It was a road with businesses on it, and many other cars parked. It was not clear to the defendant that this was a private road as there were no signs on entry to the road and no clear signage in the area that he parked. He parked on the road outside a busy, open to the public, _____LEADING CAR BRAND____  garage with other vehicles and believed he was parking legally as there was no clear reason for him to think otherwise.

On returning to his vehicle that evening after 5pm, just his car among the many parked had been left a PCN. The defendant concluded that this must be a scam from a predatory parking company and ignored the PCN. For the next 6 years he has been harassed with letters threatening court action, bailiffs, and charges – and on each occasion the amount asked for changed. The amount for parking on this road has now grown to over 200 pounds.  

It was dark on arrival to the street and on leaving the street. However, the defendant walked the length of the road in the days following the incident looking for signage and couldn’t find any – and the defendant has not received any evidence that his car was parked in an area where clear signage alerting him to it being a private road was present at that time 6 years ago.



Thanks for reading. If I have posted this in the wrong place can someone please be very clear with me where it is to go. I have read NEWBIES and lots of other info pages and couldn't work out exactly where to put my defence for review.

    You need to read again the defence template and put your paragraph 3 into a similar style; what you have there is a witness statement (which comes later in the process).  Keep the defence short, punchy and limited to legal/technical arguments.  Read a few other defences to get the idea.
    Is the original parking event six years ago or MORE than six years ago; if more than, then the PPC is too late, they only have six years to bring a claim.

    You're right, it is not exactly 6 years until 6 years yet.
    I have been looking for ages for examples of Defences on this forum. Could you tell me where the examples of other people's defences are? I have read and re read newbies many many times. Thank you
  • Just to be clear, I have read the template and used that to produce the above. But I can't find other people's examples.

    With a Claim Issue Date of 9th January, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 13th February 2023 to file your Defence.

    That's almost four weeks away. Plenty of time to produce a Defence and it is good to see that you are not leaving it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Remove the above as it's stating the obvious.

    Every paragraph needs a number.

    This one is easy enough - standard UKPC meritless claim and you'll know from @Umkomaas' DCBLegal thread that they - DCBLegal/UKPC  - will discontinue later on, with no hearing needed, as long as you follow our advice.

    Read a dozen DCBLegal threads.

    You don't have to spend hours looking!  They are right here next to your thread today, yesterday and every day.

    You'll soon suss the pattern and how to get there.

    Boat_to_Bolivia SAYS, look at the famous DCBL discontinuation thread, it's all over the internet, facebook and other media.. Rest assured UKPC cases especially the old ones, are complete rubbish. Sadly that does not stop DCBL from wasting their time

    You and a judge will quickly see that UKPC signs are junk and binoculars are required to read them ..... see a typical UKPC sign below

    This is now a game so do what the members here advise.
    There is NO DOUBT that the members on this forum are far smarter than the likes of DCBL.


    And DCBL RELY ON SUCH RUBBISH

    DCBL will have added a fake £60/£70 to the claim.  They call it damages ?   In 2017 there was no such thing as damages, even today there is no such thing as damages

    DCBL are telling you and the court, the judge, a blatant lie and that is contempt of court.

    It's no wonder DCBL discontinue before the judge gets his spanking stick out
