Hi,
I am looking for some assistance on a chargeback matter with M&S Credit Card.
I booked a flight with BA and paid a £500 deposit on the 24th Aug for a flight on the 3rd April 2023.
I cancelled the booking on the 25th August.
BA refused a refund stating this was a non refundable deposit.
I claimed this was covered by UK Distance Selling regulations and was refundable.
I have exchanged numerous emails with BA with no action.
I then submitted a Chargeback to my M&S credit card. Supplied details of the booking and my emails to BA.
They are requesting that i should supply the BA cancellation policy and the Mastercard cancellation policy.
I don't believe these have any relevance to my cancellation.
Any help on the matter would be appreciated

BA are correct - flight deposits aren't refundable for a change of mind, unless the contract specifically allows for it.
Any chargeback will ultimately fail, even if your card processes it.0 -

What ISN'T covered?There are quite a few exceptions, but they are usually in niche areas:
- ....
- Accommodation/transport/leisure services purchased for a particular timeframe

If you want to proceed then you will have to supply.
Basis, you have cancelled. BA are saying non refundable deposit.
You are going to have to prove this is not the case.
If you feel it is breech of " UK Distance Selling regulations" Which were replaced in 2014 by the Consumer Contracts Regulations
You are also missing the point that they never did cover every purchase.
