Defence for County Court Claim where you have evidenced of purchased ticket

Hi all,

I have received a letter regarding a claim form  (county court) for a parking charge. I paid for the ticket and have the electronic receipt. I believe I was issued with the parking ticket because it had not gone through straight away as it was done via a parking app.

I have submitted the acknowledgement but wanted some advice about the defence? Please can anyone help

  • Just to add that the the parking receipt I have start time is 30 minutes after the claim states I was in the car park without a ticket, which must be because it took time to go through on the parking app. 

    Will they still try and use this against me?

    What is the Issue Date on your County Court Claim Form?

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    The issue date was 09/01/23, the AOS was completed today 16/01/23

    You just use the Template Defence and put your facts in, like you see on every court claim thread.  Same as every case here.  Read a dozen.

    Surely it's more likely a VRM keying error or paying for the wrong car on the app?

    Which PPC?

    Which solicitor?

    Did you get the actual claim (you only say you got 'a letter' about a claim).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    With a Claim Issue Date of 9th January, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 13th February 2023 to file your Defence.

    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    It is UK Parking Control LTD & DCB Legal.

    I have received a claim form from the county court business centre.

    I paid for the parking on the parking app, it is the correct reg.

    Easy enough standard UKPC rubbish claim then, and you'll know from @Umkomaas' DCBLegal thread (which we won't link, these things are easy to find once you realise how easy it is to use this forum) that they - DCBLegal/UKPC  - will discontinue later on, with no hearing needed, as long as you follow our advice.

    Read a dozen DCBLegal threads.

    You'll soon suss the pattern and how to get there.

    In a short period of time DCBL has discontinued 86 mostly UKPC rubbish cases, and that's only on this forum ? a lot more will follow

  • Hi all,

    I have got the information from the SAR. They include photos of the car parked, the sign in the car park (which is blurry so I can’t read what it says) and an appeal I made at the time which included the receipt via the parking app. 
    They claim the car was parked two hours prior to the time I paid for the parking on the parking charge notice. This isn’t actually specified in their claim.

    I am not sure what to write in my defence other than the fact that I believed that I had made a valid purchase via the app.
    I will have a further dive to see if there are any further threads regarding using the parking app for payments.

    Am I right in thinking I need to use the defence template and add a short part regarding my version of events and refrain from uploading the ticket receipt until the later stage? 

    With regard to the defence template is most of the template relevant still in this case? Apologies but I’m not familiar with parking law/ cases but have been reading through the forum.

    The template defence on the front page of the forum is the most up-to-date version.  When you write your paragraph 3, keep it short, punchy and limited to technical/legal arguments.  Keep the story for the witness statement (WS) stage; read a few other defences to get the idea.  You are correct that evidence goes later with the WS.
