Well no, it's not 'just a guarantee you'll be happy with the product.'jon81uk said:Here is the website from eight years ago, Lakeland Guarantee (archive.org)
Its not very clear, they just want you to be happy and satisfied. As you've has eight happy years of use are you satisfied?
Its not a lifetime warranty. Just a guarantee you'll be happy with the product.
It contains a very specific claim:We hope you'll be delighted with our products, but if for any reason at all you're not 100% satisfied, we'll happily refund your money without delay... no 'ifs or buts' from Lakeland!
Their written undertaking is not only to refund your money but to do it 'happily'.
Nobody's lifetime mentioned.1 -
Yep it just seems to guarantee they will refund if not happy. Nothing about the life of the product.Alderbank said:

That can't have an indefinite nature to it though, otherwise everything ever sold by Lakeland could be returned for a full refund because, eventually, whatever it was you bought it will wear out and you will be unsatisfied with it and throw it away (or return it to Lakeland).
I think any such claims on a website would only be "invitation to treat" and not interpreted in the literal meaning by the courts.1 -
If Lakeland are stupid enough made an advertising claim and the OP relied on it to buy the product then won't it be covered by Carlill v Carbolic Smoke Ball Co

It's a pretty foolish statement for a company to make and Unfair Trading Regulations may come into play here.
Sure 8 years sounds good for a vacuum cleaner but there's a difference between one used 7 times a week and one used once a month.
They should have added in a timeframe, omissions are classed as misleading if they alter the economic activity of the average consumer and what Lakeland appear to have omitted is a 3 year time limit. In the game of chess you can never let your adversary see your pieces0 -
Indeed it will. The judge at the time said, 'It appears to me, therefore, that the defendants must perform their promise, and, if they have been so unwary as to expose themselves to a great many actions, so much the worse for them.'HillStreetBlues said:If Lakeland are stupid enough made an advertising claim and the OP relied on it to buy the product then won't it be covered by Carlill v Carbolic Smoke Ball Co
A more recent case was the Hoover Free Flights debacle which bankrupted the company.0 -

So OP needs go back to Lakeland citing under contract law and case law is entitled to a refund because of this statement "we'll happily refund your money without delay"
With regard to the Hoover Free Flights, I wouldn't suggest they should impound a Lakeland van.

Lakeland have since changed their T&Cs, for reasons we can only guess about, but the OP says they were the ones in force when the contract was made so they should get their money refunded.
The 'happily' part might be unenforceable.0 -
