TERMS AND CONDITIONS for “Plane on KISS - The Home Straight Show” (the “Competition”).

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

    1.ENTRY ROUTES AND COSTS

   Entry to the Competition is available via the following route only: - By calling the KISS studio phone line on 03448 11 22 33

Calls will be charged at your standard network rate.

    2.COMPETITION MECHANIC AND HOW TO WIN

 There will be five (5) winners of the competition. One each day, Monday to Friday.

To enter, you must be listening to the KISS Home Straight show with Tyler (4 pm – 7 pm) from Monday 23rd January 2023 to Friday 27th January 2023 and listen out for the phone lines opening for the on-air competition. The Presenter will instruct when lines open and close each day.

To enter, listeners must call the studio phone line (outlined in section 1) when the phone lines open. One (1) caller will be randomly selected to go through to the on-air competition. Please note if you get through to a producer, this does not guarantee that you will play or that you have won. Calls entered after lines close will be exempt from progressing in the competition.

Once a contestant is randomly selected, they will be invited on air to take part in the competition.

The competition:

Elz the Witch has been tasked with flying a flight simulator whilst completing one task each day. The tasks are:

Monday: Name 5 Gerard Butler movies

Tuesday: Name 5 airports in the UK

Wednesday: Recall 5 items from Duty-Free that the presenter read out Thursday: Name 5 phrases you might hear in a flight safety video Friday: Guess who the actor the presenter is describing.

The presenter will let Elz know what her task is each day. The contestant will then need to guess correctly if Elz the Witch will get her question right or wrong. For the tasks set on Monday – Thursday, she will need to list all 5 answers, for the question to be deemed correct. If the contestant guesses correctly, they will win the prize. If the contestant doesn’t guess correctly they do not win.

The tasks carried out by Elz the Witch are a pre-recorded element of the show. The prize is outlined in section 5. THE PRIZES.

   3. ENTRY PERIOD

   Entries must be submitted during the following entry period:

Between 4:00 pm (the “Start Time”) and 7:00 pm (“End Time”) from Monday 23rd - Friday 27th January 2023 – exact times will be given by presenters each day.

Entries received before the Start Time or after the End Time will be invalid.

Winner Announcement. The name and the hometown of the winner(s) will be announced each day at the end of each competition round.

    4. ENTRY RESTRICTIONS

  • Open to UK residents aged 18 years or over on date of entry.

• Our employees (and their family members) or employees of any company involved in the

Competition, including any Prize Provider, are not permitted to enter.

• We reserve the right to disqualify any entrant or winner who does not comply with any of the

eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

• Each entrant is limited to winning one prize per Competition. There is no limit on the value of a single prize that may be provided to the individual winners of a Competition. However, so that we can ensure fairness of our Competitions we reserve the right to prevent a person to win more than one prize valued at £500 or more via any of our Competitions in any given six (6) month period. For avoidance of doubt this means that an entrant will not be eligible to win any prize if the entrant has in the past six (6) months won a prize valued at £500 or more. We reserve the right to disqualify your mobile phone number from future Competitions during this period.

Prize package for 2 people includes: £50 per person travel allowance;

1 nights’ luxury hotel accommodation (4* min) in winner’s chosen location, based on sharing a double/twin room with breakfast included;

Admission to a high ropes course near winner’s chosen city, including all equipment hire and instruction;

Go karting activity at a karting track in winners’ chosen city, including 2 x 15-minute driving sessions per person;

and Half-day paintballing activity, including instruction, equipment hire and 200 paintballs per person – available at a range of locations nationwide.

Winner and guest must travel at the same time with the same itinerary; · At least one traveller must be aged 18 or over; Children under 18 will require parent or guardian permission prior to travel;

A valid credit or debit card will be required for security deposit purposes when checking into the hotel; Accommodation is based on 2 people sharing a double/twin room;

Hotel accommodation will be selected by the prize provider at their sole discretion;

All prize elements are subject to availability; If unavailable, experiences of a similar nature and value may be offered at prize provider’s discretion;

Winners must contact prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure;

All elements of the prize must be taken at the same time;

Prize is non-refundable and non-transferable; No cash alternative is available;

Prize is valid for 12 months from the date of notification of winning, and all travel must be completed within that time;

The prize cannot be taken from 19th December – 2nd January (Christmas and New Year), over UK public holidays, or over Easter Sunday,

Once booked, the prize cannot be amended or cancelled;

The prize excludes travel arrangements, meals and drinks (except where specified above), excursions, attractions, treatments, car hire, visas and personal expenses and anything not expressly included in the prize;

Certain height, weight and age restrictions may apply to the activities included in the prize.

     OTHER CONDITIONS

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
