Ok now I've read the letter properly the date is for a Dispute Resolution Hearing - is that the phrase used for final hearing that decides who wins, or is this something before that? The letter goes on to say:
Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing]
A one page DRH Position Statement setting out (i) the key points on your clim and amount claimed, or key points of defence and (ii) Proposed Resolution: any offers you are prepared to make for a settlement to save the further time and cost of the trial0 -
It's a waste of time preliminary 'mini-hearing (pseudo mediation... heavily in favour of Claimants) but if the Judge decides one or other party's case is hopeless, then he/she can make a final decision then and there.
So you have to treat it as seriously as a final hearing but DO NOT OFFER MONEY.
If the hearing is in September, do not rush your submission because this month we are expecting a useful announcement from the DLUHC that you might well want to take some damning phrases and analysis from, for your DRH Judge to read.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The hearing is in August, 4 weeks today. So it's not the actual final hearing but it would be to my detriment if I don't attend..? Very annoying bearing in mind I need to complete forms for it, take time off work etc.
So do we know what a DRH Position Statement has to be and should look like?0 -
