No idea. What's 'the DCUHL code of practice' and why would you want to use it?1
-
Yes you can still refer to it, which is why I have left the Template Defence still saying the added fees are 'banned' even though they're not (yet).
I explained my reasons only last week, here:

Ahhh... not DCUHL then. But instead DLUHC.

No need to say sorry, the vast majority of motorists have no clue about DLUHC and the new code of practiceDaver1978 said:Yes, sorry my mistake.
Lot to take in reading through all cases mentioned in defence letter.1 -
Yes, it is a good read and in particular a ban on scam add-ons[Deleted User] said:It's a good read and has lots of points that would help my case.
The parking industry want to scupper it
They don't like the idea of a £50 cap and they don't like a ban on the fake add-on which was approved by the BPA, THE NOW FAMOUS OSNER SCAM2 -
Why do you feel the need to name the driver?
Maybe para 2 should read...2. It is admitted the Defendant was the registered keeper of the vehicle in question but was not the driver of the vehicle at time of the alleged parking event.
Which in turn means para 3 becomes...
3. The driver was a member of Snap Fitness at the time. The driver has confirmed he was parked legally and conformed to all parking terms and conditions. The Snap fitness manager has contacted Civil Enforcement Ltd and made them aware the driver is a member. Civil enforcement agreed cancel the first 2 PCN’s but have now taken this further.
I don't think there is anything useful in your para 4 and it should be removed.1 -
Do you know that you can update the DVLA with the RK's new address online?
If you haven't already done so, suggest you do it asap and also write to the Claimant (and the CCBC if necessary) instructing them to delete your old address from their records and substitute your current address.2 -
Good advice by @KeithP; do this by sending a Data Rectification Notice to the DPO of the parking company giving your new address for service and requiring them to erase your old data and inform all and any of their agents and sub-contractors.KeithP said:Do you know that you can update the DVLA with the RK's new address online?

Hi all, thanks for the advice, just a couple of questions. The address has been updated with DVLA. What would the data rectification notice accomplish? Should I remove the drivers name but still denie being the driver?0

The address has been updated with DVLA. What would the data rectification notice accomplish? Was the court claim (if you have one) delivered to the right address? If so then the data rectification is less important than if you'd still been only at pre-action stage, but should still be done as part of the SAR , for completeness.
Wording for both SAR and address rectification in one email is already given in the NEWBIES thread.Should I remove the drivers name but still denie being the driver?Yes - if you can truthfully deny (not denie) driving, you must.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
