Can someone shed light please? A complete mess - What are my options

Hello there,

I really hope someone can shed some light on this please. I appreciate it is rather involved so I apologise but I will keep the post as short as possible.

 I brief history first - 

 My husband and I purchased a shared mortgage new build property in 2010 from a housing association.. We purchased 30%.
We divorced a few years ago.
I remain in the home with my younger 2 children.
The mortgage has been paid off.

I remain here as a tenant with the housing association.

I am registered disabled and my health is not good at all. I have mobility issues and other illness/disorders I live with. I received benefits and PIP for my long term health complications.

My history of working is part time and few and far between. When me and my husband were together he worked full time and I did on and off part time but my health got worse from around 2015 onwards so barely worked. But we got by.

I do not have much money (savings)

I need to move house due to ASB issues which the housing association al ways fail to sort out properly. The ASB has gone on, on and off for a decade.

I have contacted citizen's advise but they will not help with shared ownership issues.
plus the local council will not help because I am adequately housed.

Now for my questions please

The housing association have said they cannot help but

Could they help me move with like for like as a tenant or do I have to sell ? Do they have a duty to help me because of the ongoing issues?

If I sell, I cannot afford another mortgage because of my circumstances. I wouldn't even qualify for a mortgage. - do I have options with this please?

I cannot afford to rent. So I know I need to stay in the buy system.
Can I qualify for share to buy again and use the percentage of my sale of this home to help me into another shared ownership?

I am aware I could be helped buy the HOLD scheme however I am not completely happy with certain aspects of this scheme. It is a little concerning. So unless there is another option which I could research then I will have to maybe bite the bullet with the HOLD scheme.

    I can’t comment on the shared ownership, but wanted to ask how much equity you have for your 30 per cent share and whether 50% of that is due to your ex husband should you sell?

    Hi there, thanks for responding. The title deeds are in my sole name. So no miney due tomorrow ex. Not sure on the equity.

    If you sold then 30% of the equity would be yours. As it is a shared ownership property there may be some restrictions on selling that you should check out, but basically there money is yours. You could use it to buy another shared ownership property with the equity from this one being the equity used to buy the new one.

    You may even be able to get a mortgage with the benefits you are on and afford to buy, a broker could advise.

    Hi there, Thanks for your message. Sorry I been delayed in responding. So I assume I would need to look on the gov sites for advice on equity mortgages? I am totally unaware if there are specific brokers for people who are in my situation (financially). I will search on this.

    I think you are in one of those catch 22 situations...

    If you sell then you will then have cash/savings so will not be a priority in being housed by the council, so you would have to rent privately. 

    The 30% is not enough to buy a house outright with and you cannot get a mortgage.

    Can you contact the people you bought it from then sell back to them and use the 30% equity as a deposit for another part buy property in another location? 

    What are the ASB issues? Can they not be solved?

    Yes so you see my dilema here, I contacted the housing association and they have confirmed that if I sell that the first procedure is a 3 month nomination period for other sellers. If then no buyer comes forward it can then go on the open market. They will not consider buying my percentage back from me. 

    I am hoping to find some resources for using my equity to buy into another shared ownership. I have left a message for the housing association on this matter too, But so far, what I have read, I may not be allowed.

    Unfortuantely the ASB is treated as minimal each time it hapens. The case gets closed. A few months go by and I have contact them again with complaints and the same procedure occurs They never do enough to deal with the perpetrators. This has gone on for years. The perpetrators does things which aqcuaint to low level asb, gets a ticking off by authorities, santions put in like good behaviour periods, The the ASB case gets closed. The a few months go by and something else starts. And all the time perpetraors lie through their teeth. I now have cameras installed but these can only do so much and the law is so sketchy with cctv. laws for private use when using to help for ASB issues.

    The ASB has gone on, on and off for 12 years now,
  • Demitria I'm sorry to read you've been suffering for so long.  I'm only 4 years with my neighbours from hell.  If it weren't for my Victim Support volunteer I'm not sure I'd still be here ( not catastrophising and am on meds for the anxiety and depression).
    We have reported umpteen asb incidents and actual assaults.  The police take more notice when I report everything as a disability hate crime, they make it very apparent in the comments they use. That said 3 of us were assaulted 6 months ago and one suspect still hasn't been interviewed under caution.  
    We still love the house and all the other neighbours and want to stay.  Ultimately,  we may have to move though.
    Sending a bit of moral support without any practical help. x
