Entitlement to 30 hours free on LCWRA?

Hi just trying to get some feedback re entitlement to 30 hours free childcare on UC with LCWRA. My husband has had his work capability assessment and has been awarded LCWRA. We have applied for the 30 hours free childcare (we are in England) as the Turn to Us website indicated that we are entitled but it has been rejected as he doesn’t have the qualifying benefits which they state are ESA etc. We have submitted a mandatory review request and sent in proof of the LCWRA and the information from Turn to Us, but just wondered if anyone else had any experience in this area and any success in appealing the decision?

    Could it be you are trying to claim the wrong benefit?  hopefully someone will advise you of that.


    You would be entitled (if you work) for https://www.gov.uk/guidance/universal-credit-childcare-costs

    If your partner does not work but cannot look after your children

    You can still claim childcare costs if your partner:

    • has a health condition or disability which means they have limited capability for work (LCW) or limited capability for work related activity (LCWRA)

     "assessed as having limited capability for work for Universal Credit purposes"

    What is the age(s) of the child(ren)?
    That might help getting a fuller answers from one of the experts on here.

    On a UC claim for a couple, the 30 hours free childcare is available, if one of the couple works and the other has LCWRA so cannot work.

    Normally for a couple claim, if one is employed and the other is unemployed, the childcare is not available, as the unemployed parent is available to care for their children.  It is the unemployed person having LCWRA that allows for the childcare to become payable.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
  • Hi just to update; we filled in the mandatory review and sent this off with proof of the LCWRA and a print off from Turn To Us which states LCWRA is a qualifying benefit - and it was accepted so we have been given a code for the 30 hours free childcare.
