    Yes, treating that in isolation, I would say it's all over.

    But I am a little concerned about what might be above that WARNING statement.
    What are these words referring to?...

  • I did wonder about that and we haven't had any terms sent to us or mentioned in any previous correspondence. 
    Would it be worth phoning someone tomorrow to check? 
    I've just cut the top of the letter off as it has my husbands details on and our address.

    Could it just be a copy of the letter sent to the Claimant? Is there anything in the order dated 24th July 2023?
  • You should contact the court and ask the question.

    As far as I can see, the case has been struck out due to the email from DCBL

    We have looked back at all paperwork and there is nothing to say about any terms for my husband. He is going to phone the court tomorrow to check there isn't anything we have missed. 

    It's brilliant news that it has been struck out of court - thank you to everyone for your help with all of this.

    Please can you show the previous Order this Summer that told them to file 'further & better particulars'?  You would have been sent a copy.

    If you haven't got it - please ask the court for it (THE PREVIOUS ORDER) when the Defendant phones up the court, and ask too (cheekily) for a copy of the solicitors email refusing the order, because you were "left out of the loop" and need to see what led to this latest Order - just in case it is appealed.

    Be polite but friendly/pushy. Say you need to see what you were not included in / did not receive.

    See what he can get emailed to him by a friendly court clerk to complete the picture.  We would love to see what led to this win!

  • Here is the letter we recieved in July. We thought it would go further and was another part of the step so waited on more correspondence before asking on here what we should do next. 

    I phoned the court today but there was nobody available who could talk about the claim and the warning on the claim.

    I guess we will never know what DCBLegal sent by email but whatever it was, DDJ McMurtrie wasn't at all happy with it!

    So that we can refer to this judgment to support others in future, could you tell us the Claim Number now it is all over and not a live claim?

    Then we can refer to it by Claim number.
