Hi, i have recently applied for a mortgage as me and my wife are buying our council house through the right to buy scheme, we have a deadline of 30th of january 2023 to accept offer and complete deal, we were turned down by the halifax as something showed up on my credit file, at this moment i am unaware i have a ccj on my credit file, the halifax mortgage advisor was great but could not tell me what the problem was only that it was blocking me from getting a mortgage, he suggested a specialist mortgage brkker who deals with bad credit scores so we contacted haysto, we were told to do a credit check through checkmyfile which we did and sent results back to advisor who told me about the ccj on my file, basically said not much he can do with ccj on my credit file, the ccj has been on my account since june 2021 and i have only just found out about it, the ccj was brought to court by hoist finance, it should have been given to my son but instead its been given to me, we have the same name apart from he has a middle name which always shows on any letters he recieves, is there anything i can do to speed up removal of this ccj or will i have to accept that i will miss deadline for house and if yes will i be entitled to compensation from hoist for this wrongly issued ccj affecting my mortgage application, thanks.

It is unlikely that the CCJ will be removed by the deadline that you have for completion - although the fact that it is on your file as a 'miss trace' would make it easier / quicker than dealing with the Court. In respect of compensation for losses, you only can claim for any losses that you can fully substantiate.2
