Tribunals

Wondering about people opinions on the issue.

If a person wins at a  benefit tribunal,  do you feel the DWP are less likely  lower or remove the award at next review if nothing stated has changed, or that it has no bearing?
Can the DM even see if the DWP has been overruled at some point in time?

    In my opinion it has no bearing.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    Can the DM even see if the DWP has been overruled at some point in time?
    Quite possibly not.  One way to make sure would be to include it in the evidence for the next claim.

    Logically you'd think it ought to have a bearing, but realistically this *is* the DWP …

    However, if a subsequent assessment lowers / removes a tribunal award, when the health conditions / abilities of the claimant have not improved - and this decision is appealed, then (given a sensible claimant submission) it is very, very likely that another tribunal panel will reinstate the first tribunal award.   

    In the unlikely event of reducing a previous tribunal award (whilst accepting that the health conditions / abilities of the claimant have not improved), the tribunal panel would need to be very clear in the decision letter as to why they have arrived at a that decision.
