PCN for Chalfont and Latimer Station from NCP

Hi

Came back from visiting family over Christmas to a parking charge notice from NCP. The date of the incident is 13th October 2022 and the date of the notice is 22nd December 2022. Taken directly from the paperwork, "This charge relates to the period of parking specified in this document, the charge having been incurred due to the following breach of the car park terms and conditions of use: No payment and liability for the same having been brought to the attention of the driver by clear signage in and arround the site at the time of parking.

There is no mention of POFA and so I assume there is no time limit for the charge to arrive by i.e. 14 days? No ticket was issued at the time and the paperwork states that the alleged breach was picked up by ANPR cameras.

I am planning to use the standard response where byelaws are involved and to focus on not-relevant land and therefore no keeper liability?

Any advice/pointers greatly appreciated.

    Chalfont & Latimer tube station car park is covered by Railway Byelaws.

    Confirmation that its subject to TfL Byelaws as from November 2014:-

    This means that POFA doesn't apply and the keeper has no liability.
    For this reason it is important that the driver's identity is not given away.

    This will be easy as pie.  Lack of POFA kills this stone dead at POPLA.

    A keeper appellant has 100% easy win here.  Just copy the 'non-POFA, so get lost' style appeal people have used on any thread where I've recently replied 'easy when you know how'.

    Had one yesterday.  I do not have a link but I just saw it again on page one with a response this afternoon, so a little reading of today's posts by you, will find it.
