Discharged from IVA
Options
Hi all,
I'm terrified at the moment. Just before Christmas I was discharged from an IVA. The debt consist of 4 CCJs worth 17k that I'd foolishly racked up when I was a student about 15 years ago. I maxed out credit cards and overdrafts and moved house various times unaware of the implicatiobs in the long run. These eventually caught up with me and I decided on a IVA as my credit was already terrible at that point. I had a job and everything was ok for a couple of years - I made regular payments etc.
At the very beginning of Covid my workplace folded and I was made redundant (the company was already struggling and this was before furlough came along) I was on universal credit equivalent of JSA and I was giving a decent grace period to get myself sorted. However, towards the end of this time I developed atrial fibrillation and (because of COVID) waited 13 months to get a cardiogram (restarting of my heart). I tried contacting the IVA but literally could not get through on the phone. I'd wait 20 mins then hear call centre noise and they would hang up. I emailed the case officer who would not deal with it via email and told me to keep phoning. It ended up being discharged at the end of November 2022. I now have the 4 CCJs and I would like to know the best way forward. They are all issued from the County Court Business Centre in the UK. I've tried ringing a couple of times but again can't get through.
I want to inform them that I have moved house and that I want to start paying this debt off.
I am still unwell as now I seem to have an issue with my thyroid (which may have caused the heart issue) and I am awaiting a specialist appointment. Obviously NHS is stretched at the moment so no idea how long that's going to be.
I'm struggling to keep phoning them everyday because it's eating my phone credit. Can someone advise me on the best course of action? If I'm able to write, is there a template I can use and how do I explain still not being able to pay. It's causing me so much anxiety the heart palpitations have started again and I can feel myself getting unwell.
Thanks

Stop phoning.
There is no point trying to contact Northampton Court as they will have zero interest in your debts. All they do is rubber-stamp the demand by your creditors, then wave goodbye.
As your IVA has been terminated, the insolvency practitioner will inform your creditors of that fact.
You may be surprised at who you now owe money to as often debts change hands when they go into an insolvency situation.
So you need to wait until all four creditors have written to you and then take advice. In the meantime you can just respond to anyone who writes to you with a standard holding letter like this one
https://nationaldebtline.org/sample-letters/hold-action-your-account/
It was probable that an IVA was not suited to your circumstances anyway.
In the meantime get your health sorted and see if you can save into a 'fighting fund' in case these things re-emerge.
Also you should know that a ccj cannot be enforced (without specific permission of the court) if it is over 6 years old1 -
Thank you kindly for the response. I have moved house now but applied for electoral register. I understand this takes time - I'm just trying to be honest and upfront to get it sorted. I'm concerned they will use my old address and it will get thrown away. Other than paying £33 for the post office is there any other way I can update my address so that creditors can see? I tried to do it in credit karma but it says I have to wait until at least 4 creditors confirm my address somehow.
Thanks again. Really appreciate the help and advice0 -
If you're on the electoral roll and have your bank account registered at your new address (and any other financial product that you are currently using) then anyone who wants to find you can do so.
Let them do the work on that - just concentrate on getting well and saving a lump sum.1 -
Nothing will happen overnight here, it may take many months for any new collection activity to start.
When were those CCJ`s granted, because any judgement over 6 years old you can, for all intents and purposes, ignore, as its very rare for a creditor to seek to enforce judgements of that age.
