  • Have you asked the company to arrange collection of the goods yet?

You have to remember that banks have no binding authority on these things, they may reverse the financial transaction but they do not rescind the contract or change ownership etc.

In reality most companies just write it off as wastage but some, and particularly smaller ones, will pursue you for the debt given you've now got the goods and havent paid for them. There are many stories on here of a chargeback win coming through and a few weeks latter a letter before action to take them to court.

Just because a bank has decided to reverse the payment doesnt mean you have escaped the contract, just means the onus is now on the merchant to collect the debt. You'd often be long beyond the timescale to return the goods depending on the actual background of the chargeback by the time the bank's processes have concluded.

I have since requested the company to collect the goods on advice of credit card company. Before the chargeback was started they were supposed to send me a pre paid return label - this was the 'resolution' after several emails following their return policy to the letter, a visit to store where my return was refused !! Completely incorrect instructions TWICE  lied to by shop staff.... a long story but after over 40 mins of refusing to leave the above was promised. An email was sent but no pre paid label just a different return address - at my cost to post !!           They are now saying ( only 48 hours later) they cannot send a label at the moment ( another broken promise/lie) or collect ? They have sent a link to royal mail saying it will be free...  I haven't looked at it yet but not confident as lost all faith in anything they say.                                                 Can I insist they collect ?

You didnt say in the initial post what the actual issue was... are the goods faulty? Was it a change of mind return on a web order?

A bit of both.... ordered online 3 pair of wide fit trainers. 1 pair sent std fit not wide. Other 2 tight fit despite being wide.  Sorry reply took so long had problems posting ?
The Royal Mail link has worked but I haven't taken them to PO yet.

So the wrong item sent the seller would always have to cover the return postage (though it could be done by refund rather than up front). For the two items that just arent right for you rather than being faulty/wrong description then it would come down to the T&Cs of the sale as distance selling rules allow that to be the customer's costs.

In practice the cost of sending multiple items together is not normally 3x the cost of one return and so for easy life merchants may just pay for the full return given they are already incurring the cost for the picking error.
