Parking Eye appeal - pregnant

Hi,
I have parked in a Home Bargains car park for 20 minutes over the allotted 1hr30 time allowed. My appeal was very short and along the lines of "my wife is heavily pregnant and due to the equality act of 2010 please cancel this charge". Unfortunately I didn't do my homework and just sent off the appeal based on the citizens advice suggesting that I should appeal because of pregnancy being protected by the EA. I wish I'd seen this forum first before appealing.
Now I'm being told to appeal to POPLA. Do I have any chance of successfully appealing based on a pregnant passenger? Thanks.

Because according to citizens advice, being pregnant means that the charge should be cancelled. I was parked so long because I was initially unaware that there was a 1hr30 time limit, was trying to get around a massive store with my wife who can't move very well given being pregnant.Brie said:what does your wife being pregnant have to do with why you were parked so long?1 -
Makes sense - I suspect this may run for a bit unless Home Bargains will cancel the charge on your behalf.I’m a Forum Ambassador and I support the Forum Team on Debt Free Wannabe, Old Style Money Saving and Pensions boards. Unfortunately having spoken to the store manager, they're washing their hands of it as per it being a car park owned by a third party (which for me means they couldn't care less about my experience at their store of which I'd suggest the car park is one aspect of it).Brie said:Makes sense - I suspect this may run for a bit unless Home Bargains will cancel the charge on your behalf.0 -
OK - in that case you need to proceed to the next step on the stickies. I'm not an expert but that seems to be the only route to take short of paying your hard earned ££ to a carpy company.
As I understand it you need to do the POPLA appeal and then further stuff when it might finally go to court where either you will be in front of a judge rather than an automated "computer says no" programme and you can plead your case or you'll show up in court and no one else will be there in which case you will win by default.I’m a Forum Ambassador and I support the Forum Team on Debt Free Wannabe, Old Style Money Saving and Pensions boards. No, before POPLA try a robust complaint about the EA 2010 to whoever does own/run the retail park.
Why are CAB (England) so useless about private parking scams yet CAB Scotland really get it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Parking Eye own the car park, not Home Bargains. Having spoken to the store manager they gave me the same line as they have on their website which is "owned by a third party, take it up with them".Coupon-mad said:No, before POPLA try a robust complaint about the EA 2010 to whoever does own/run the retail park.

I'm also going to speak to citizens advice to clarify where I stand. Their website is quite clear in saying a parking charge should be cancelled if you are pregnant.
Parking Eye told me in the rejection that I did not provide sufficient evidence that the terms and conditions were not breached. I'm not sure how I was supposed to provide evidence of my wife's pregnancy but I didn't expect to need medical notes etc.0 -
Parking Eye own the car park,No they don't. Absolutely not.
I was telling you to take it up with the 'third party' (the site landowner or agents) who own/run the car park. That is NOT in a million years ParkingEye!I'm also going to speak to citizens advice to clarify where I stand. Please don't waste your time. They are clueless and will not be able to answer you with any knowledge at all, Sadly CAB are hopeless on private parking charges.
You haven't read NEWBIES PLEASE READ THESE FAQS FIRST yet, we assume?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I doubt very much doubt that Parking Eye own the care park and imagine Home Bargains are living in cloud cuckkoo land
STOP talking to the CAB, they are good at many things but when it comes to the parking scam, they really are clueless
Do so at your own peril
Your wife being pregnant, well done, does not exclude her. It now depends on signage and in general Parking Eye signs are rubbish which need binoculars to read them.2
