Confused about PIP entitlement finish date

I am receiving PIP since 16 November 2019 after I won at tribunal level. I was awarded 3 years, so the letter said my benefits would end in 16 November 2022. I get the money on Tuesdays. The award was for autism which is a condition that doesn't change so I was surprised I got only 3 years.

It is my understanding that when you are awarded PIP at tribunal level they do not recall you for a review, that the benefit should end and that's it and that if you wish to claim again you have to do it yourself. And they have not recalled me or contacted me at all since I was told I won the tribunal.

When am I supposed to get the last payment? would it be in the November payment or in the December payment? I assumed that November would be my last payment and it would cover just half a month (1 to 16) but I got the full pay and today I also got a full month's pay?? Is this the DWP not realising my entitlement is done or do they extend it without telling people? I am a bit confused and I am not sure what to expect or do. I wanted to ask here first as I don't want to call (I don't do well on the phone). I don't want to keep the money if its a mistake and potentially be fined...

Thanks

Ordinarily you would be correct and a review of a tribunal decision would have to take place at the end of the period it was set for but as far as reviews are concerned DWP is still under extra ordinary measures with only urgent cases taken forward.  You could ring them if it puts your mind at rest but your PIP should continue until they request a review.

  • But they said in the letter than after tribunal they would not do a review, it would end and if I wanted to continue getting PIP then I would need to start a new claim from zero. That is why I am confused????

In normal times they would write to you before the end of the tribunal award advising you that you need to make a new claim in order to continue to receive PIP. If they have not written to you it is likely that they have extended your award and the fact you have been paid indicates this. If you want to check that an extension has been made and if so how long for then you need to ring them.

Check all your files...  You may have had a letter from DWP extending the award end date due to Covid issues some time last year?

Our PIP award ends in 12 months - except we got a letter in '21 extending it to Sep '24...

In the absence of a letter in your hand, the only way to know any new end date is to ask DWP.

  • I’ve called and they said I’m due a review and that they will send the paperwork for the review today…. I shouldn’t have called 😡

It’s better to have matters progressed rather than suddenly having the award stop without warning.
