    Just read the NEWBIES thread which covers all your questions and includes a template appeal.
    Please re-read what I said just hours ago (above).  Nothing has changed.

    They have signposted me to the IAS.... am i screwed?
    No.

    You won't be paying. We already said this.  Please stop talking about owing money and affordability.

    Why think you are screwed when a PPC has admitted they didn't use and can't rely on the POFA?!

    Thanks, i appreciate the guidance. I read the stickies at the top of the forum, but they seemed a bit confusing as to what is in date and what is not. Sorry, I asked questions I wasn't sure on the answers to, i am sure like many others find first time around, the responses from the parking firm appeared credible, as though i was daft and quoting something irrelevant and they knew best. Coming here has been reassuring.

    As previous, regarding the dart charge, get in touch with them if you make a balls up with payment of the dart charge, or forgot then they are usually helpful if this is the first time and things generally work out ok if you are polite

    I called Dart Charge just now. I have to make an online representation, which I will do which at the very least will suspend the process for a bit, if declined will at least give me 5-6 weeks to find the money to pay them.
  • Thought i'd update you wonderful folk.

    Re: Parking with ease - I appealed, they responded and ignored all the valid points in my appeal so i have sent for adjudication. I am not hopeful but not to fussed either now. Their case is contradictory, full of assumptions about driver v keeper liability; more holes than a sieve.

    DartCharge - my success. I paid for the crossings late. I then opened an account so it didn't happen again and I pleased my case, which was essentially that i hadn't deliberately not paid, I just forgot, i was really annoyed with myself. i told them I  opened an account to show that i had taken steps to avoid this happening again. I also said I am skint and used the appeal process to buy  myself some time to potentially have to save the money to pay the PCN's. I was brutally honest in my appeal, because I didn't actually think they would cancel the PCN's - but they did. I got a letter this morning and they have used their discretion , with a cursory 'don't do it again'. Buzzing. There's some good people in the world!!

    Nicely done on the Dart front. They are pretty good at dealing with genuine errors using a common sense approach. In somewhat stark contrast to the private parking sector.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
