Timberland Returns Policy

I've just received a refund for the return of boots to Timberland - minus the £3.95 delivery charge.  (Only the first time in my 65 years that a size 11 was too tight - I must be still growing.)

Their refund policy states: 'In case of returns for change of mind (right of withdrawal), you will be fully reimbursed apart from shipping costs for express delivery, if you had chosen this shipping method.'  I didn't opt for express delivery so am I right in thinking that they shouldn't have withheld my £3.95?

    Yes, they should reimburse standard delivery costs:

    34.—(1) The trader must reimburse all payments, other than payments for delivery, received from the consumer, subject to paragraph (10).

    (2) The trader must reimburse any payment for delivery received from the consumer, unless the consumer expressly chose a kind of delivery costing more than the least expensive common and generally acceptable kind of delivery offered by the trader.

    (3) In that case, the trader must reimburse any payment for delivery received from the consumer up to the amount the consumer would have paid if the consumer had chosen the least expensive common and generally acceptable kind of delivery offered by the trader.

    No, it was the original delivery charge.  The return was free.

  • Odd reply just received from Timberland:
    "I can confirm that the Shipping Fees are always refunded separately from the items being returned. In this case, the refund for the item might appear first on your account or second, depending on the time frames to approve this at the warehouse."
