Britannia Parking appeal reply asking for name and address of driver

Hello,

I first received a PCN from Britannia Parking on 18th november with a date of contravention of 2nd november at Waitrose carpark (16 days apart, relevant?). The letter was asking me to identify the name and address of the driver.

I appealed the notice stating that I was the registered keeper but was not the driver and that they should contact the driver of the vehicle at the time. I also did not tell them who the driver was. I also stated that as this was over 14 days since the contravention date that they cannot asign the PCN to the registered keeper (got advice that this may indeed be the case).

Well today I received a reply from the appeal again asking for the name and address of the keeper. (see image below of letter). How should I best handle the reply to this letter? I had already told them that i was not going to tell them the name and address of the driver, should I repeat? Any help would be appreciated.

I have look at the Newbies thread and it pretty difficult to navigate and I could not find anything specific to this issue, therefore as advised I had started a new thread.

    Thanks for the prompt response KeithP. I appealed the first PCN letter where they were asking for details of the driver stating that I was NOT the driver (see original pcn letter below). 


    It seems the evidence they are waiting for on the appeal response letter the is the name of the address of the driver, which I obviously will not be providing them. Are they stating that the appeal may be ignored unless I provide the name and address of the driver? That doesn't seem right does it.

    Yes just saw that thanks KeithP. Although, still not sure how best to manage this then...

    On the back of the original PCN it says "once your appeal has been received the PCN will be put on hold. We will respond with the outcome of your appeal within 35 days. If we decline yor appeal, you will be provided with details of how to further appeal to the POPLA, along with a unique reference number" 

    This seems to match the wording in their appeal response. So are they just stating that should the 35 days pass without evidence that the appeal will be rejected, or do you think they are stating that this appeal will be ignored unless I supply additional evidence of who the driver was? It seems like the first to me but it is not obvious to me.

    From the quote in your opening post they are saying "Please be aware due to awaiting for additional evidence your appeal response may exceed our 35 day deadline".

    My interpretation of that is that if you don't give them driver's details within the original timescale allowed for making an appeal then they will ignore your appeal altogether.

    The BPA need to know about this and I am sure @Coupon-mad will have an opinion too.

    Advise the BPA of this as it's very misleading.

    Britannia joined the BPA because they could get access to the DVLA FOR THE REGISTERED KEEPER.  NOT THE DRIVER
    Even the DVLA don't know who the driver is ?

    We are seeing an ever increasing load of rubbish letters from these parking scammers who are no doubt in panic mode about the new code of practice

    What complete fools thinking the driver has to pay when they don't know who the driver is.

    Based on that stupid letter, saying "the driver is required to pay" are they saying there is no requirement for the registered keeper to pay

    They however are required to act in a professional manner and reply to your appeal as registered keeper. Of course they will reject it, give you a POPLA code and who knows what POPLA will do ?

    You have no option but to ignore such rubbish

    So we think the best course of action is to do nothing at this stage and wait for them to reject the appeal, if I understand correctly.

    If that happens and I get the POPLA code, what would be the procedure there? To appeal to POPLA stating that I am not the driver?

    I think enough is enough.  Tell them to stop playing games.

    You could add this wording based loosely on some wording used by @Grizebeck to hurry along the cancellation:

    This was an appeal by the registered keeper. I have appealed and do not need to appeal again, nor name the driver. No driver details will be given and this was made clear already so stop begging; it's becoming embarrassing and is a waste of your time and mine.  This is your bad, for not complying with Schedule 4 this time. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code, where you will give up anyway.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    YES, the BPA should be told about the rubbish from Britannia.  

    Britannia have to reject your appeal and they are obliged to send you a POPLA code

    NOW, don't expect much from POPLA, they have proven themslves not to be as independent as they portrayed, they support parking scammers. All part of the mega scam the BPA run

    This is playtime with money scammers and it's good fun.  But just wait, Britannia have to send you a POPLA CODE.  Depends at POPLA if you get the tea boy replying or the head tea boy...... that's how bad they are now.
    IT'S A BPA THING ?

    Tell us what happens next with these fools which will now be in January or later.
