Another Ticket to contest

19 Posts

Morning,
Had good advice on her previous regarding to two Heathrow PCN's received. First time ever had a ticket in 12 years driving and only gone and got another PCN within a month. The driver of the vehicle ovestayed a max 3 free hour parking by 50 minutes.
This is a retail par park that is split between Costa, Aldi and B&Q. I have attempted to get manager at Costa to request to revoke ticket but am not having much luck. I shall be continuing to send a complaint to both Costa and Aldi with copies of proof of purchases spent on the day etc. I have however been away and will need to appeal to Euro Car Parks as 28 deadline in a few days.
I have read through Newbie stickie patch and searched forums for any similar Euro Car park cases. Am I right in thinking that the initial appeal should be along the lines of the template below only at this stage? Or shall I include everything regarding; Non-compliance with requirements and timetable set out in Schedule 4 of POFA 2012, The operator has not shown that the individual who it is pursuing is in fact the driver who was liable for the charge, poor photo evidence etc? Or is this just used when conducting the Popla appeal? Thanks
(template will use below)
Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
Give a man a fish, and you feed him for a day; show him how to catch fish, and you feed him for a lifetime.
But ALSO try a complaint to B&Q saying you were looking possible Christmas presents for a DIY enthusiast relative that day and have now been put off returning.

So date of event is 09/11 and date issued is 18/11.
Does this mean that any chance of getting this revoked is only by pushing the retailers present for the car park? (Aldi, costa, B&Q etc) ?
