Parking Eye Fine - Range Car Park

I have received a parking fine for the range car park in St Helens. 
On Sunday the 27th the car was parked for over 2 hours. 2hours 38mins to be exact, the maximum stay is 2 hours however the store was closed (time states arrived at 5.50) …

I have read the newbies thread and I am going to appeal it! I just wanted to make a new post so that I can get help to make sure that I am doing it right? Template for the first appeal do I just send that exact one? Even though I know some of the details? 

I am also confused about making a complaint to the store because 1. It was closed at time of parking  2. Is that not me admitting liability? 

Any help will be appreciated!

    I can't see you winning this, sorry.  You will not win at POPLA unless this is a lease car or a non-POFA golden ticket (see image linked in the 3rd post of the NEWBIES thread).

    38 minutes over.  Store closed so you were using their car park for something else.  I don't see an out.

  • Hey thanks for your reply… so I was under the impression that I can say I wasn’t driving 🙈. But is this not the case? I’ve been into store and they also said they couldn’t help because of the store being closed.

    You don't seem to have read the NEWBIES thread nor yet understood the difference between a POFA PCN and a non-POFA one, which we can't explain here because it's already explained (with a nice picture of what to look for) where I signposted you to read.

  • Ahh right yes I understand now. Mine isn’t a golden ticket 😫 …. And has the POFA… It is all so confusing and so much information to remember I forgot I’d read that bit! As I had read it all before I received my ticket as there were a few of us who have received them so I knew it was coming!

  • The question you need to ask yourself is why did you park there and overstay. Did you not see the signs? Is it possible you did not see them and therefore did not agree to the terms and conditions that were probably in the smallest font. For a contract to be formed (which is what these scam PPCs rely on) legally there has to be an offer, consideration and acceptance. If the signs aren’t clear and obvious you have a defence.

    Whilst your appeal might not be successful you (and anyone else who has been stuck with a PCN) could defend it in court if that is the case. Get some photos of the signs. What is the name of the PPC? Whilst all will try it on and put pressure on through debt collectors some are more ready to go to court than others.

    In the thread title - ParkingEye.  The OP is faced with a bit of an uphill battle with them, given the circumstances.

    Not sure why drivers don't just park on-street in the evenings!  You can park in any town or city free of charge on street without going anywhere near any private car parks.
