I would really appreciate help and advice please.

Yesterday I received a letter from DCBL, “Notice of debt recovery – unpaid CCJ”.  This is the first I have heard about this – all previous letters were sent to a previous address.

This morning I contacted the County Court Business Centre who emailed me the details of the case.

Claimant: HIGHVIEW PARKING LIMITED
Date of county court judgment: 13/10/2022
I received the letter yesterday (although it arrived last week – I have been away).

There is already a lot of information on the forum about this, which I am grateful for.

In particular, the Jack5656 thread with a letter to copy.

My case may be different for two reasons:

1.       Experian were not aware of my move (until today). Nor am I on the electoral register. But I do have energy bills and council tax at this location.

2.       Jack5656 ordered that the claim struck out as the claim form having not been served within 4 months of issue. This doesn’t apply in my case.

What I’m wondering is whether I have a chance of set aside being granted, given that a soft trace for my address may not have (at the time of the judgement) returned my current address?

If so, am I better off seeking a set-aside with consent from the claimant?

Although I am wondering how have now found my current address in order to have sent this notice of debt recovery.

Thank you very much I would really really appreciate any help.
