    He should have already told them of any modifications, they can then decide if the modifications count for changing the policy

    Agreed - it's a standard clause in pretty much every policy I've every seen that you must inform them of any modifications.  As well as it being a standard question when you go through the initial application form, "Has the car been modified from standard factory specifications?".  And as you say, there are lots of insignificant modifications that actually wouldn't change the insurance premium much, if at all.


    Changing the exhaust muffler may not have impacted the insurance directly, but may mean it was an MOT fail (non-approved exhaust for the vehicle) which may impact insurance.
    Just to clarify, lack of an MOT (even if that turned out to be the case) does not automatically invalidate insurance.  It may reduce the amount they'd pay out to the policyholder for a total loss, on the basis that the car is worth less without an MOT than with - but certainly as far as third-party liability goes, it won't matter.
