Hello, I'm wondering if someone can give me some advice. Back in August 2022, I looked online to purchase a sofa..,. wanted to see it in store before purchasing so went into store. They didn't have it.. so came home, looked a little more and then made the purchase at home. I ordered a 3 seater, however what arrived was more like a 2 due to the size of the arms. I tried to like it for a week but became apparent its not what I thought it would be. So called to cancel. I explained that I had been in store to see the sofa but wasn't one available. I had explained that I purchased online but they told me that due to the fact I walked in store made the purchase a store purchase and the 14-day return won't cover the purchase. This was argued for most of Sunday evening. In the end they agreed that if I paid a 40% fee against the sofa I ordered (1,600) and I make a new order within 5 days then they will collect the one I have. Im not sure why I need to pay another £645.00, so they can accept the return. Its almost like thats my fine.

Since the sofa you were looking for in store wasn't there, I can't see how they can argue it was an in-store purchase.  Are you absolutely clear it wasn't there?  It wasn't a case of the same sofa being in-store but just in a different colour, for example?

Where you are on shaky ground is the week's use.  The part of the legislation relating to online purchases is designed to give you the chance to try a product out as you would be able to in-store.  Sitting on a sofa for a week isn't something you would be able to do in-store.  Surely the size problem was apparent immediately?
