Highview parking charge

Good evening a friend has received a Highview Parking charge letter in the post. They never received the Charge on the 3/11 as stated in the letter and this is the first letter they have received.

Friend is not the driver but the owner, the driver insists they paid for parking, as they frequently use this shopping centre. However, they have paid cash and didn't keep the ticket as it was back in September. 



I have advised that the owner complains to the Shopping centre and I believe the next step is to appeal as the owner using the blue template.

Based on the letter above, would this be correct?

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

As your Parking Charge Notice does not comply with the requirements of the Protection of Freedoms Act 2012 (Schedule 4), you are, in law, unable to hold the registered keeper of the vehicle liable for the parking charge; I suggest therefore that you contact the driver. As there is no legal requirement placed on the registered keeper to identify the driver, I will not be doing so.

    Just a little update, after a complaint to the shopping centre, my friend has just received an email back and they have cancelled the PCN.  They have said there were problems with the machines that day. 

    So thanks to this fantastic forum and advice, my friend would have paid due to the anxiety and fear that if she didn't she'd have debt recovery after her.

    And we sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?

    Looks unlikely to be published before Xmas, but keep your eyes peeled in early 2023.

    We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that actually funds the court claim and toxic CCJ culture, as well as the DRA gaslighting of people.  Your friend would have paid under duress, had that happened.

    Cannot be right in this Country.
