Aged Chargeback Claim Item - Advice Needed

Hi all - I used my Amex to purchase an item for £48 which the seller failed to deliver as they did not have it in stock and they cancelled the order. I have yet to receive a refund. I have been chasing the seller and they keep telling me that they are sorry and that it is being processed. This is now over 6 months old. I tried to raise a Chargeback claim to Amex, but they refused saying that it was too old.

Do I have to go to the small claims court now or is there another option?

    Don't know about Amex, but for Visa/Mastercard it's 540 days reportedly - Debit card chargeback claim

    My understanding is that (for all three card schemes) it's 120 days from scheduled delivery of goods/services, with a longstop of 540 days from purchase date for the latter.

    That only comes into play for future dated events. So in OP's case you are looking at Amex std time limit. 
    If OP could get a email from retailer saying will refund with a date, amount & last 4 of card that should being it back within time limit.

    Many thanks born-again, so just to be clear what you are saying is that if I get the seller to put a proposed refund date in an Email and then that time passes I am back in the game with Amex as effectively the date is reset to the proposed date rather than the original date of debit in May?

    Not being thick at all 👍

    It would with Visa. you would need to check with Amex, as they is not anything I have dealt with.
