PCN help - DCB Legal

  • True - I was looking at the car park on Google Maps - and the car park they've clocked me in is separate to the Tescos. Hence my confusion.  Agree I am now contradicting what I've said.

    The defendant did not receive any letters regarding the infringement – as they had moved from the address the letter was sent to until 2022 – when the defendant asked to appeal their case. The defendant attempted to speak to Highview Parking but were transferred to DCB Legal – where they were told they could not appeal

    If you are going to use this defence, I would tidy that part up so that it reads better, and more accurately. Something like -

    The defendant did not receive any notification regarding this alleged contravention until 2022, due to having moved from the address used by Highview . Once aware, attempts were made to appeal, only to be told by DCB Legal that no appeal was possible.
    The pen is mightier than the sword ..... and I have many pens.

    Just add the bit about the 2 car parks to your point #2 and say that this was so long ago that you are reduced to guessing which day it was, but it may have been a day when you were driving, met a colleague and the car was in fact moved between two car parks.

    Then your point 3

    Then NUMBER your point 4 of course; you cannot have unnumbered paragraphs in a defence.

  • Thank you all for your help on this. 

    Can I ask which defence do you think I'd have a better chance with:

    1. As I was only 17 minutes over the time limit - and the cameras caught me at the entrance then it can take time to park and also leave the car park.

    2. I moved the car between the car parks.

  • thank you okay so does this defence look okay - am using the template from the newbies thread but just amending points 2 and 3

    2.   It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied. The Defendant has limited memory of this unremarkable day over 5 years ago and has been reduced to guessing which day it was. However, this may have been the day when the Defendant was driving and met a work colleague for a meeting at the Tesco Extra.

    3. The Defendant believes she may have visited the Tesco Extra Rydon Lane Retail Park on the 19th October 2017 for a work meeting with a colleague, at the coffee shop. The Defendant thinks she entered the Retail Park, to then leave to go to the Tesco’s Car Park. The Defendants believes she may have returned to the Retail Park 3 hours later to collect something from the shops. The Defendant also believes that the car park is quite big so it can take time to find a space from entering the car park. 

    The defendant did not receive any notification regarding this alleged contravention until 2022, due to having moved from the address used by Highview. Once aware, attempts were made to appeal, only to be told by DCB Legal that no appeal was possible.
