TERMS AND CONDITIONS for “Argos – Absolute Radio – T&CS” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

 

 

1.Entry ROUTES and Costs	Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   (A)     Online at absoluteradio.co.uk or planetradio.co.uk/absoluter-radio   Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	There will be one (1) winner of the Competition each day, with five (5) winners during the campaign period.   Pre-registration -          Anyone interested in taking part in this competition must register their interest on the online competition. -          Registering to take part in this competition does not provide any guarantee that you will come on-air or win a prize. Shortlisting and being invited to play the on-air game. -          The Absolute Radio Production (ARP) team will pick a selection of shortlisted entrants from the pre-registered entries, drawn by random electronic draw. -          The ARP team will contact the shortlisted entrants to check their availability to play the on-air game, with a time and date in which the game will take place. The entrants will be requested to reply by a certain time to register their interest and confirm their availability for the next phase. The registering participant will at this stage need to provide contact details for their chosen “other” who will participate in the game with them. The registering participant must have permission from their chosen “other” to pass contact information. The other must also meet all terms and condition requirements. -          Being contacted does not guarantee an entrant will come on-air or continue to the next phase of the competition. -          Once shortlisted entrants have been contacts a finalist will be selected from those who have replied to confirm they are available to take part and the finalist will be selected. If an entrant is successfully chosen and selected to play the game, they must be contactable the phone number provided for both the entrant and their chosen other on the time and date agreed with the ARP team. How to win -          The contestant and their chosen “other” who have been selected to play the on-air game will answer a series of questions to increase the prize pot. The questions will alternate between winning cash and winning increase value on their Argos Egift card. -          The on-air breakfast team will highlight which question adds to which pot (Cash or egift card) and the amount per question. -          It is  at the discretion of the ARP team and the on-air breakfast team, if questions are to be answers separately or together. If they are separately, the on-air breakfast team will identify if who the question is for to answer. Ie the initial entrant or their “other”
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   From 00:01 Monday 28th Nov 2022 (the “Start Time”) to 10.00am Thursday 8thDecember 2022 (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.   Shortlisted contestants will be contacted at least 1 day before they are to come on-air to win. Ie Tuesday’s contestant will be selected and called on Monday.   The on-air competition period will play out in the Dave berry Breakfast show from 06:00 – 10:00, Monday to Friday 5th – 9th December.   The final contestant will be selected on Thursday 8th December.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, they or anyone living at the winning address will not be eligible to win this competition. If by any chance they get through to the phone lines – any prize they have been successful with will not be awarded. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. 5. THE PRIZE	The winner will receive the following prize (the “Prize”):   1 x £1,000 in Cash 1 x £1,000 via an Argos Egift Card.   Please note, only the contestant that registered their interest in the competition will win the prize. The contestant is not obliged to split any winnings with their chosen partner who helps them win the competition.   The prize provider of £1,000 in cash will be provided by Bauer Media. Prizes are non-transferable & non-refundable.   The Prize provider of the £1,000 via an Argos Egift Card will be provided by Element (the “Prize Provider”). We are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.   Prizes are non-transferable, non-refundable and no cash alternative will be offered.     Additional Terms and Conditions from Element (the “Prize Provider”).    All prizes are subject to availability. In the event that any of the products listed above are unavailable, alternative products of equal value will be provided; Due to the Covid-19 pandemic, there may be delays to deliveries of physical prizes; Element will endeavour to get products delivered to winners as quickly as possible. All elements of the prize are subject to availability; Prize is non-refundable and non-transferable; No cash alternative is available; Prizes may need to be signed for on delivery and it is the recipient’s responsibility to ensure that all items are present, correct and undamaged; Recipient may need to provide ID on delivery; It is the responsibility of the winner or the winner’s parent/guardian to provide the correct delivery information to the prize provider; Items will be delivered to one address within mainland UK; Prizes will be delivered within 28 days of confirming delivery address with prize provider; The prize excludes anything not expressly listed above; The Prize Provider is Element London Ltd (www.element-london.com).

 

OTHER CONDITIONS

 

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS.

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
