Paid for Parking received Parking Notice - Horizon Parking

Hi, 

I need some guidance and help with a Parking notice I just received from Horizon Parking following a stay at Premier Inn A23 Gatwick North.

On the night in question my wife and I arrived at the Hotel and parked at around 8pm (3rd Nov) and departed approx 4am (4th Nov), I was instructed to use the payment terminal in the hotel reception and paid £16 (completely extortionate but there you go!) I dont recall the terminal asking me for my number plate (it was 4am in the morning!) 

Anyway end of last week I receive a parking notice from Horizon for an £85 for failure to pay for parking, I appealed the notice and sent a snip from my bank statement showing the £16 payment taken and paid to Horizon albeit it showed the payment date as the 7th Nov (I guess thats when they processed it) 

My appeal has been rejected, they have offered me to pay £50 in 14 days or send evidence of the vehicle the payment was made against, to be honest this feels outrageous to me given I paid for parking! I cant call them to discuss just write or appeal to the onbudsman or POPLA.  

Any advice on how to proceed with the least effort on my part to get this closed down, I feel very aggrieved having to write and spend my time and money arguing a complete injustice and it really feels this approach from them is heavy handed and purposefully aggressive and unhelpful with available modes of communication.

    Therefore you have lost your easy winning points which you would had you not rushed into an appeal
  • Thats not overly helpful Grizebeck, I followed the appeal process thinking it was straight forward as I paid for parking!

    Do you have any helpful advice to offer or are you just killing time trolling?

    Grizebeck is not trolling but has, albeit rather bluntly, told you that revealing the driver's identity (if that is the case) has thrown away an easy win against Highview.

    What happened when you complained to the hotel manager/CEO?

    Plan A is always to complain to the landowner and your MP.

    You won't have been given the opportunity to appeal to any ombudsman, only the non-independent appeals service PoPLA.

    If Plan A fails, then construct a PoPLA appeal using all the relevant points available to you that you will find in the third post of the NEWBIES sticky Announcement. Post your draft here for checking before you submit it.

    Your appeal should include at least,

    Not the landowner
    No standing to issue charges in their own name
    Any BPA CoP failures
    Inadequate signage
    Airport byelaws (failure to pay for parking is not a byelaws breach)

    If the driver's identity hasn't been revealed then you can also add, non PoFA compliant NTK.

  • Thanks for the guidance Fruitcake I'm following up with the Hotel now and as the next step.  

    The rejection email did say I could appeal to POPLA and Ombudsman services as an alternative dispute resolution just pointed out Horizon have not chosen to participate in their appeal process so i'd have to appeal to POPLA regardless.

    That's standard.

    As others said, you had 100% win nailed on at POPLA, had you appealed as registered keeper. Now it's 50-50 I'm afraid as your appeal stopped you using the winning point.

    We are saying this to stop you doing that next time.  No trolling here, just explaining what NOT to do next time!

    Obviously PLAN A (Hotel complaint) comes FIRST as the NEWBIES FAQS tells everyone.

    Never try POPLA first as that can cause a PPC to refuse to cancel when the Hotel tell them to.

    And even if you do have a POPLA rejection it is not legally binding on the motorist.
