Help regarding new home rettention

            Yopu need to get Persimmons to email you that they have received full payment if you spoke to them on the phone.

CA told me to respond to solicitors and ask for a full detailed explanation as to why they seem to think we owe this and give a cut off response by end of day today..
Not heard a word so i assume with what i have already sent them they have no leg to stand on...
Seeing astho they sent me this distressing letter i feel like saying that there !!!!!! up lead to persimmon beibg paid in full where as had that retention had of been retained id not of agreed to let it go with all the problems we had and the promise of compensation from persimmon that never happened....
Have a folder of faults.. We moved in dec 2019 fri... Sat my husband went to plumb washing machine in and noticed floor saturated... Had to vave everything ripped up downstairs due to a poorly soldered pipe on boiler and my dreamnew home spent 9wks with concrete floors.... This was one of many....0 - 
            
You cant send something and demand a response during that day, set a realistic deadline for them to confirm that you actually owe the money. You submit your evidence and that should take care of the facts.lorr13 said:Thanks for your advice.

The condition of the house, well welcome to being a home owner its never rosy!1 - 
            Its wasn't same day I gave them a week....
And when u purchase a brand new home u don't expect the troubles we had..... Googl3 persimmons and its everywhere...
Ive actually owned 4 homes including this one..... A brand new home u do not expect what we had... Never had anything like it0 -

So did you raise any of this as part of your snagging list? New homes are renowned for issues.1 -

Just to be clear - that isn't necessarily proof that no problem exists.
For example, it could be that your solicitors paid Persimmon £5k, and your solicitors now realise that they didn't ask you for that £5k first.
So you still owe your solicitors £5k.
It's probably still a matter of going through the numbers, to see who's right and who's wrong.

            It might be a mistake by the solicitor, it certainly sounds like it and if so, its not acceptable for the solicitor to send this sort of letter threatening court action. If it's their mistake, an explanation and an apology is the least to be expected.0

Not that the solicitors would have accidentally "lent" £5k towards the price from their own funds - but depending on the numbers I suppose it's possible that the solicitors have fully paid Persimmon but used funds which they should have allocated to pay their own costs - in which case as you say it would be a matter between the OP and the solicitors (and the OP would still need to pay).             Well this is why I have contacted them for a detailed explanation and have not yet received any correspondence after a week yet they gave me 14 days to pay 3yrs later!!
I should not be liable for there mistake if they did pay persimmons and didnt takebit out of our monies... And to have this letter 3yrs later is a disgrace..
The threat was to pay by 1st dec so if they fail to respond to me i honestly cant see how they can do this to me and expect me to pay for there mess up...?0
