APCOA unsuccessful appeal -
rmbrown
Hi, before posting I did read almost all the posts and did not find any information similar to my situation.
I forgot to pay the £5 charge within 24hrs, but I did pay it within 7 days.
I received a PCN about 4 days after that.
I appealed explaining that I forgot and had paid late.
My appeal has been unsuccessful. Which leads me to believe they are more interested in making money via PCN than by the actual charge. Criminal.
I have the option of appealing to POPLA. Oh and I have to apply for a refund for the £5.
My question is, what grounds to I have to appeal now, considering my first appeal basically admits that I was the driver?
One post reads "Just ignore APCOA. Nothing will happen."
If they sell the debt on to a debt recovery agency, doesn't that mean that you could potentially have a CCJ against you?
Thanks for reading and for any feedback. Much appreciated...

One post reads "Just ignore APCOA. Nothing will happen."Still applies. You won't win at POPLA given what you've stated, so just ignore it.If they sell the debt on to a debt recovery agency, doesn't that mean that you could potentially have a CCJ against you?Nope. They cannot 'sell' on to a DRA, not allowed in their contract with the DVLA which provides them access to the registered keeper database. You only get a credit-affecting CCJ if it goes to court, you lose or fail to defend and you don't pay the cost order by the date given by the Judge! A DRA can't take you to court and APCOA don't do court! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you decide to go the ignore route, that includes not worrying nor telling us about debt collector letters. Already clobbered to death in post #4 of the NEWBIES thread, which begs for no new posts about DRA letters!
Yes you will get letters. No, APCOA can't have 'sold the debt'.
If you do the above, do NOT apply for a refund of the £5 of course because if ever APCOA break the habit of a lifetime and try a small claim, the fact you paid the fiver blows apart any legitimate interest argument they would otherwise have in pursuing you for £80.PRIVATE 'PCN'? Is this about an airport drop off?
If so, which airport?0 -
Heathrow.
There are no others using APCOA for drop off areas. The OP must have searched & found literally hundreds of threads here since a year ago when they started this little game. No-one has been daft enough to pay (obviously they should pay the fiver but ONLY where they actually used the drop off bays, not all those victims who merely drove through, of which there are dozens on here alone).
NCP ruin people with a similar scheme at Gatwick.
NSL ruin people in a similar way at Stansted.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
