Help needed regarding reposession

  • OP is highly unlikely to be able to make any offer of clearing arrears as he says he relies on £250 from the rent to live on and some days he cannot eat.

Where are you living OP and how are you supporting yourself? Would it not make sense to come back, get a job and perhaps even house share with this person you allowed to rent from you.

You say that the agent has been 'very good', but they a) failed to issue an S8 after 2 month's arrears, b) failed to check you had a BTL mortgage or consent to let, and c) failed to contract the tenant with a written AST? It doesn't inspire much confidence in them.
Sorry but I just don't believe this is the whole story.
It's very likely that any attempt to get a possession order will fail, as it's fairly inevitable that your tenancy is not regularised in some respect (deposit protected, GSC, EICR, How to Rent booklet etc?), and even once this is resolved, it will be well into the spring before you could actually evict the tenant.
The tenant has no agreement in place the estate agent adviced me to get a btl I didn't get round to it as I'm abroad bereavement do you think I should tell the bank that I'll volunteer repossession plz advice me further. I have no idea what to do & this is all my life time hard with into this house
When you were living in the property, how did you manage to pay your mortgage?  Have you stopped working since going abroad in March?  Are you planning to come back at all?
And if the reason for leaving was a bereavement, is there an inheritance due to come which will help?

I'm guessing the OP has missed all correspondence from the bank which might explain why it's all happened so quickly. Or the tenant may have returned everything to sender, causing them to realise it was let or that the OP had disappeared. Fine if they'd kept paying, but with arrears and possible information they'd left the country, I guess it would be a priority repossession.

  • Thanks guys for all your advice I have emailed the solicitor & been very truthful & told them I'm in breach of the residential mortgage which was not intentional but circumstantial.ive always believed honesty is the best policy so I'm sure I'll get the best outcome once a big thanks to all those who replied.may God reward you all for your advice.Ameen.
I will update the post with developments as I'm sure I'll be needing your support. Thanks again
It's funny it's ironic how strangers whom I don't even know are more helpful than my own family.

I don't understand how you can go abroad in March and its November and you are still there?  Why would you give up your job for that? You don't get on with your family but you went as grandfather was ill?  Is grandfather still ill?

You did rent your house on a residential mortgage intentionally, it doesn't matter what the circumstances were, its a decision you made.

I suggest that you contact the British embassy in whichever country you are in, and ask for help to get repatriation to the UK. You are a British citizen, and you are entitled to their help to get back here.

When you return, you should have no problem getting a job, as there’s a big shortage of workers at the moment. Can you stay with friends until you get yourself settled?

Once back, and in work, you have some chance of sorting this out with your lenders. You will need to evict the tenants, which will cost money, and could take ages.

Still, it’s better than starving where you are.

Anyway, that would be my game plan in your position.
No reliance should be placed on the above! Absolutely none, do you hear?
