Hi all

Can someone clarify something for me.

Are the IPC able to obtain vehicle keeper data?

From what I can interpret, the below link would suggest not as I do no believe they’re UKAS accredited:

” It is the decision of the Secretary of State that requests for vehicle keeper data from the Driver and Vehicle Licensing Agency (DVLA) be granted to members of accredited parking associations to manage parking on their premises directly or as contracted parking operators, unless DVLA has information that shows release of this data would be inappropriate. An accredited parking association is one whose members have been certified by a conformity assessment body which itself has been accredited by the United Kingdom Accreditation Service (UKAS), the national accreditation body. Certification establishes a parking operator’s ongoing conformity of operation in accordance with the requirements of this Code of Practice, subject to ongoing audit by the relevant conformity assessment body.”

Or am I getting excited when it says the code of practice from the above link is  is “withdrawn”?

I assume the below is still the legislative guidance to follow?

    The IPC itself does not obtain DVLA registered keeper data, but its members can and do (8.5 million times last year!). The ability of a private parking operator to obtain RK data from the DVLA is contingent on them being a member of an Accredited Trade Association (either the IPC or the BPA). 

    The National Statutory Code of Practice is temporarily withdrawn to enable an impact assessment and a follow-on (third!) consultation to be undertaken (later this year/early next year) after PPCs and ATAs squealed about the proposed reduction in the level of the parking charge and the outlawing of the spurious debt recovery/admin charge and launched at least two hugely costly Judicial Reviews against the Govt's CoP. 

    The Protection of Freedoms Act 2012 (Schedule 4) relates to keeper liability; one of the conditions for transferring liability from the driver to the keeper is the need for the keeper's data to be obtained via the Secretary of State responsible for the DVLA.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    That’s great, thanks for the information!

    I have a lease/hire vehicle, so I’m well prepared for any ‘invoices’ from these firms.

    I may get a slip on the windscreen from Link Parking where I park my car sometimes. They won’t follow the whole hire vehicle protocol, so bring it on!!

    Corrected for you. PPCs monitor this forum and if a poster gives away too much information the driver's identity can sometimes be determined by them.

    Don’t worry about me giving away too much detail, but I understand your point!

    It wouldn’t be the first time I’ve had to defend PCN’s and have won on both occasions. That was with the help on this forum 👍🏻

    If you have a lease vehicle, unless you are 100% certain the lease firm will not pay as soon as they get a NTK in the post, you must send the template appeal online within two weeks(ish) - and certainly before day 21.

    As long as you know not to ignore a windscreen PCN, and go to real efforts NOT to ever get an ANPR PCN sent to the lease firm (by always reading signs and avoiding such car parks at pubs, restaurants, shops, etc.) you are safe from the scam and your lease firm will never get any letters. 
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
