Turkey hotel Contract with TUI

We booked a hotel called Montana Pine Resort in Oludeniz Turkey with TUI for May 2023. We have now been informed by the hotel that TUI haven't renewed the contract with them for 2023 but have done for 2024. According to our local TUI shop it means our holiday with them to Montana Pine Resort won't be going ahead but we cannot get TUI to confirm this so we can get our money back sooner rather than later as we don't want to be offered any other hotels by TUI when they eventually decide to tell us it's cancelled.

Is there any action we can take to force TUI into confirming our holiday is cancelled so we can get our money back and book with another company?

    Regardless of whether it's what you want or not, TUI are entitled to offer you a hotel of equivalent standard in the same resort, so even if/when they confirm to you that your original choice is no longer available, that doesn't in itself grant you unilateral cancellation and refund rights.

    The only likely exception to what eskbanker correctly states would be if you have anything in writing stating that you were only interested in staying at that specific hotel.  There is almost always a clause in the contract to cover hotels not being available.
  • We chose that hotel deliberately for our 25th wedding anniversary next year having been to Montana Pine Resort in 2020. It's our intention to still go there whether TUI like it or not.

    As above the problem you might have is that the TUI T&C's will allow them to move you to an equivalent hotel in the same resort. They might allow you to cancel but they certainly don't have to allow you to.

    Hopefully it's some sort of oversight and maybe the contract will be sorted out. It would be strange if they've operated before to that hotel and are planning to operate in 2024, but not 2023.  It's still on sale for 2023, although that doesn't confirm anything.
  • There's definitely something wonky between TUI and the Montana Pine Hotel. They DID actually sell it for 2023
     - I've just returned from there after booking with TUI , I enjoyed it a lot, it is a good hotel.
    But now, when I look to book for 2024 to return - NO - it does not seem to be available for 2024 from TUI at all, not even listed online.
    Though Jet2 ARE offering it for 2024 so I can solve my problem that way.......

    Not sure if you have booked a package holiday

    From what I understand and have had recent experience in if you book a hotel /accommodation  only with a travel company apparently the contract is with the provider in that country. There is literally no point in booking up with a holiday company in Britain for accommodation only . You would  be better off going direct? Which is effectively what the travel company is contracting you into unfortunately like myself we have only just realised this when there was a problem
    the travel companies in Britain are like Teflon, nothing sticks.
