FBU & other Unions - Public Sector Pensions Judicial Review

  • An update on this issue for anyone interested (potentially affects anyone in a public sector pension scheme).

    The FBU were unsuccessful in their Judicial Review application last January. However, an appeal has been lodged and it has just been given a date of 20 Feb 2024 for this appeal to be heard.

    As a reminder (and without going into all the very complex detail) a successful appeal will equate to a finding that people in public sector pension schemes have been overpaying pension contributions since April 2019 by about 2%, which will then presumably need to be addressed and the overpaid contributions restored to members.
  • As advised in the previous post, this case was heard by the Court of Appeal over three days last week. I even watched some of it on the livestream (yes, I should get a life!). Verdict now being considered, but no indication as to when it will be delivered.

    Is there anywhere to see a recording of the live stream? I didn't even know these sorts of things had a live stream so anyone can watch them. This is just out of curiosity (I have no legal knowledge of these things).

    From PCS Union website today:

    The Court Of Appeal has delivered a disappointing judgment today, rejecting the appeal by PCS and other unions against the UK Government’s meddling with the pension cost control arrangements. 

    This has denied members the reductions of pension contributions, which they were due from 2019, amounting to more than £1,000 in most cases.

    PCS and the other unions involved in this legal case will now be considering the next steps we can take in conjunction with our lawyers.
