Fitting replacement windows and cavity closers

Does any one know the Building Regulation that covers the replacing of cavity closers while fitting replacement windows and doors. I have seen it somewhere and goes something like "Although the installer is under no obligation to bring the work area up to the current Building Regulations, he/she is none the less required to ensure that work is left no less weatherproof than when he/she started." or something like that. My cavity closers were ripped out in order to replace the windows and not replaced. One of the windows is leaking and I need to quote a regulation to get them to fix it.

    I would say that you don't need to quote a regulation to get them fixed. New windows shouldn't leak, and if they do leak, then they were not installed correctly. 

    The doubt the phrase you used in your post would actually appear in the acutal Building Regulations. I think it more likely that it would appear in guidance to the regulations, possibly prepared by an organisation like FENSA. If they are just guidenace, they are unlikely to bind the installer. 
    The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.
  • thank you for your reply to my question. As you say, a new window shouldn't leak. The installer is trying to claim my rendering is faulty but is doing exactly as it is supposed to do. This is just something to add to a list of comments claiming poor installation. 
    There is a part in the Building Regulations that covers this issue, it is Approved Document 7 page iii under Building Work "b. for work on an existing building that did not comply with the applicable requirements of the Building Regulations: (i) the work itself must comply with the applicable requirements of the Building Regulations (ii) the building must be no more unsatisfactory in relation to the requirements than before the work was carried out." in case you are interested. It is not quite as I had seen it before but will do.
