You cannot usually get Attendance Allowance if you live in a care home and your care is paid for by your local authority. You can still claim Attendance Allowance if you pay for all your care home costs yourself.

Thanks both for clarifying. Although I assume it would make no difference to the person concerned as they would just get to keep the £25 anyway.

Definitely attendance allowance if you are self funding & at the higher rate. The manager at my mother's care home told me that if she wasn't getting top rate top let her know because if you needed to be in there you were due the top rate & she would help.

OP, your mother will have had a financial assessment at the point she moved into the care home.If she’s not a self funder or receiving fully funded nursing care, then as has already been said she will be left with a £25 a week personal allowance and the rest would go to her contribution towards her care. There is no mechanism for the local authority to claim anything else back after she passes away, as long as you have let them know if she goes back up to the threshold at which her savings will affect the contribution that she pays.All shall be well, and all shall be well, and all manner of things shall be well.
