Money Claim Online

Hi all

Can someone advise why defending a case is not recommended to do so on the MCOL website and instead to email them the defence?
I need to defend myself on another matter (not parking) and have no templates to help me so was just going to start my defence online so I don't miss any key required info.

Thanks

Sam

As Bargepole says in his 'what happens when' post linked from the NEWBIES thread...
I recommend printing and posting (registered) to Northampton, trying to fit it in the online box destroys the formatting, and makes it hard for the Judge to read.

That was written in 2016 and we now suggest that a Defence is emailed to the CCBC (or court if the CCBC are not involved).

Also the size of the online box may not be big enough, so a Judge will be presented with a truncated document too.

Never try to type (or worse, hand write) your Defence into the online form. Noy only does it split the text over several sections, making it harder for a Judge to read, it also marks you out as a rank amateur who has no clue as to what you are doing.

It should be in a separate PDF document, headed with the case number and the parties' names, and set out as a series of numbered paragraphs, each dealing with a specific point in the Claimant's particulars, either admitting or denying their pleadings on each point.

It should be written in the third person, e.g. ''The Defendant denies that a valid contract existed...'' and so on. No 'I', 'me', or 'we'.

It should be set out in Times Roman 12pt, with 1,5 line spacing, and signed and dated at the end with a CPR-compliant Statement of Truth,

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
